Power of Attorney - Walkthrough
Power of Atttorney forms for Muslims who want to complete their Islamic Will and Legacy Plan
Why You Should Designate Powers of Attorney
Your legally valid Islamic Will gives an individual (the executor) authority to make decisions on your behalf after you die.
A power of attorney is a legal document that gives an individual authority to make decisions on your behalf before you die.
Powers of attorney are important to have in place in case you are incapacitated (i.e. you’re not healthy enough to make decisions on your own).
There are two types of power of attorney you can grant someone:
đź’° Financial Power of Attorney
This gives someone authority to act on your behalf in financial and property matters. This is sometimes called an “Enduring Power of Attorney.”
🏥 Healthcare Power of Attorney
This gives someone authority to make decisions about your healthcare. There are several different names for this in Canada - a “proxy”, “directive,” “personal directive,” or “representation agreement.
- You can provide specific directions on this form describing how you’d like to be cared for in case you’re unable to articulate it yourself. A sample healthcare directive is provided below.
Sample Healthcare Directive
I want all medical treatments to preserve my life if there is a reasonable chance of recovery and the ability to return to a meaningful state of health.
I do not want treatment to be used solely to prolong the dying process if I am in an irreversible, terminal state, as determined by qualified medical professionals, where recovery is not possible.
I accept temporary use of ventilators, CPR, feeding tubes, dialysis, and medications if they provide a chance for recovery.
I refuse prolonged use of life support machines or artificial nutrition if I am in a persistent vegetative state or my death is imminent with no chance of recovery.
Any decision about the use, continuation, or withdrawal of life-sustaining treatments should be made in consultation with qualified medical professionals and, if needed, an Islamic scholar or trusted Islamic authority.
I request that all care, including palliative care, is consistent with Islamic principles of dignity, mercy, and reliance on Allah.
